The Commodity Futures Trading Commission (CFTC) has opened a public comment period on proposals to allow futures contracts that track the price of AI compute power, a move that could give companies a new way to hedge against rising and volatile costs. The request for input follows the Chicago Mercantile Exchangeโ€™s (CME) announcement that it plans to launch a trading product for AI compute in October, after a series of pilot tests and regulatory reviews.

AI models now consume more than 10โ€ฏ% of global cloudโ€‘compute capacity, with large language model training running on GPUs and TPUs that can cost hundreds of thousands of dollars per month. As demand for these resources climbs, so does the risk that a sudden spike in compute prices could derail projects or inflate the cost of consumer AI services. A futures market would let dataโ€‘center operators lock in prices ahead of time, while AIโ€‘heavy firms could protect themselves from supply shortages. The CFTCโ€™s review is the first step toward ensuring that such contracts meet federal oversight standards and do not create systemic risks or unfair market manipulation.

Industry analysts say the new contracts could also open up AI compute to a broader group of investors. โ€œIf the CMEโ€™s product is priced transparently and regulated properly, it could become a standard tool for managing cost risk in the AI supply chain,โ€ said Maya Patel, a marketโ€‘risk analyst at FinTech Insights. Dataโ€‘center operators like Equinix and Amazon Web Services have already expressed interest in offering hedging tools to their customers. The next few weeks will see the CFTC receive public comments until the end of September. After reviewing stakeholder feedback, the agency is expected to issue a final rule by early 2025. If approved, the CMEโ€™s October launch would mark the first time a regulated futures market exists for AI compute, potentially reshaping how the technology sector manages supply and cost. The outcome will likely influence future regulatory approaches to other emerging tech markets, such as quantum computing and autonomous vehicle data.
