Former Venezuelan President Nicolás Maduro and his wife, Cilia Flores, have asked a federal judge in Manhattan to dismiss drug trafficking charges against them, citing sovereign immunity. The couple's lawyers filed the motion on Wednesday, arguing that no American court has jurisdiction over a sitting foreign leader. They contend that Maduro's status as the recognized head of state of Venezuela protects him from prosecution in the U.S.

This legal maneuver comes ahead of their scheduled trial set for June 1, 2024. The allegations against Maduro and Flores stem from a long-running case that first emerged six years ago, accusing them of conspiring to traffic cocaine into the United States. Oral arguments on the motion to dismiss will take place on November 17, with Judge Alvin K. Hellerstein presiding. Maduro, 63, and Flores, 69, have been in custody at a Brooklyn jail since they were captured by U.S. forces in a raid on their home in Caracas earlier this year.

In their filings, lawyers for both defendants emphasized that Maduro's immunity as head of state should lead to the dismissal of the case. They argue that this principle is a long-standing aspect of international law. Flores's attorneys also asserted that she enjoys the same sovereign immunity protections. U.S. prosecutors allege that Maduro orchestrated a conspiracy to smuggle thousands of tons of cocaine into the country while working with Venezuelan law enforcement.

The implications of this case are significant. If the court grants the motion to dismiss, it could set a precedent regarding the prosecution of foreign leaders in U.S. courts. Conversely, if the trial proceeds, both Maduro and Flores could face life sentences if convicted. The outcome may also impact U.S.-Venezuela relations, which have been strained for years, especially during the Trump administration, which characterized the operation to capture Maduro as a necessary law enforcement action.
