A federal judge in California has issued a significant ruling to halt specific Department of Homeland Security field operations aimed at identifying noncitizens who may have illegally voted. U.S. District Judge Araceli Martรญnez-Olguรญn, an appointee of President Joe Biden, issued a nineteen-page order late Wednesday that restricts armed Homeland Security Investigations officers from conducting home visits and interviews in nine states. The states affected by this preliminary injunction include California, Connecticut, Georgia, Missouri, Nevada, New York, Pennsylvania, Washington, and Wisconsin. The judge determined that the agencyโ€™s current methods are flawed and likely violate the Voting Rights Act by creating an environment of voter intimidation. This legal move comes at a critical time, just weeks before major state primary elections, including Californiaโ€™s primary scheduled for June 2, 2026.

The courtโ€™s decision highlights deep concerns about the reliability of the data driving these enforcement actions. Martรญnez-Olguรญn cited recent disclosures from a U.S. Citizenship and Immigration Services whistleblower who alleged that target lists were created through rushed matching processes. These lists reportedly contain the names of U.S. citizens, including individuals who have already naturalized but voted prior to completing the process. The judge noted that the combination of unreliable data and highly publicized arrests, such as a recent incident in California where agents were seen handcuffing a man, generates an objectively reasonable fear among voters. This fear chills the exercise of democratic rights, as citizens may become reluctant to urge or aid others in voting due to the threat of law enforcement entanglement.

In response to the ruling, officials from USCIS defended their procedures while acknowledging the inherent risks in the data matching process. Nicolas Bartell, a USCIS official, submitted a declaration stating that his team manually reviews records before referring cases to HSI. However, he admitted there is a "low possibility" that citizens could be erroneously identified as potential noncitizens in federal records. Bartell argued that these remaining risks were outweighed by the agencyโ€™s mission to support election integrity and enforce immigration laws. Despite these assurances, the judge found that the government had not demonstrated sufficient safeguards to prevent the targeting of lawful voters. The order specifically bars DHS officers from conducting operations based solely on USCIS matching data without further, independent investigation.

The long-term impact of this ruling on the federal governmentโ€™s broader campaign remains uncertain. The Department of Homeland Security has maintained a firm stance, stating through social media and official statements that it is laser-focused on identifying and prosecuting noncitizens who vote. The agency argues that only Americans should elect American leaders and that such actions dilute the votes of lawful citizens. However, independent state reviews and audits have consistently shown that voting by noncitizens is an extremely rare occurrence. Critics of the operation argue that the aggressive tactics used by HSI are disproportionately disruptive and stigmatize immigrant communities. As the legal battle continues, the ruling serves as a check on executive authority, emphasizing the need for precise data and due process in efforts to protect the integrity of the electoral system.
