Sen. Bernie Sanders (I-Vt.) announced Monday he will introduce legislation to stop the federal government from garnishing Social Security benefits for seniors with unpaid student loan payments. The proposed bill, named the Stop Social Security Garnishment Act of 2026, aims to protect vulnerable older Americans by preventing the Education Department from deducting funds from their Social Security checks to cover outstanding student debt.

This legislation comes amid growing concerns over the financial burden of student loans on older Americans. Approximately 3.5 million seniors owe a combined total of nearly $100 billion in student loan debt. Many of these individuals took out loans for their own education or to assist their children and grandchildren. With rising living costs and fixed incomes, the garnishment of Social Security can push these seniors further into poverty, making it difficult for them to afford basic necessities.

The issue gained traction as stories of seniors losing essential income surfaced, prompting advocates to call for reform. The Biden administration has already taken steps to ease the burden for some borrowers, including a pause on federal student loan payments during the COVID-19 pandemic. However, garnishment of Social Security benefits for those with unpaid loans has remained a contentious issue, drawing bipartisan attention and concern.

If passed, Sanders' bill would mark a significant shift in how student debt is managed for older Americans. It could also set a precedent for broader reforms in the student loan system, as lawmakers and the public continue to grapple with the implications of student debt on various demographics. As discussions around the bill unfold, it could lead to renewed debates on higher education financing and its long-term impact on American families.
